Terms of Service

1. Acceptance of Terms

By downloading, installing, or using any application developed by vcxz ("we", "our", or "us"), including PandAlarm, IndoorVoice, and Scraps (collectively, the "Apps"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our Apps.

2. License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to use our Apps for personal, non-commercial purposes on devices you own or control, subject to these Terms and the App Store Terms of Service.

3. App-Specific Terms

PandAlarm

  • PandAlarm is an alarm clock and sleep tracking application.
  • While we strive for reliability, we cannot guarantee the alarm will function under all circumstances (e.g., device powered off, Do Not Disturb mode, system failures).
  • You are responsible for ensuring your device settings allow notifications and alarms.
  • Sleep tracking data is for informational purposes only and should not be used as medical advice.
  • Snore detection is an estimate based on audio analysis and may not be 100% accurate.

IndoorVoice

  • IndoorVoice is a voice level monitoring application.
  • The app requires microphone access to function.
  • Volume measurements are approximate and may vary based on device hardware and environmental factors.

Scraps

  • Scraps is a recipe saving and organization application.
  • The app uses AI services (Google Gemini) to extract recipe data from images and text. AI-generated results may not always be accurate.
  • You are responsible for verifying the accuracy of extracted recipe data, including ingredients, quantities, and cooking instructions.
  • The app requires camera access for recipe scanning and ingredient identification features.
  • Recipe suggestions based on identified ingredients are for inspiration only and do not account for food safety, freshness, or individual health conditions.

4. Subscriptions and Payments

Some features require a Premium subscription:

  • Subscriptions are billed through Apple's App Store.
  • Payment will be charged to your Apple ID account at confirmation of purchase.
  • Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.
  • You can manage and cancel subscriptions in your App Store account settings.
  • No refunds are provided for partial subscription periods.
  • Prices may change with reasonable notice; continued use after price changes constitutes acceptance.

5. User Conduct

You agree not to:

  • Reverse engineer, decompile, or disassemble the Apps
  • Modify, adapt, or create derivative works based on the Apps
  • Remove, alter, or obscure any proprietary notices
  • Use the Apps for any unlawful purpose
  • Attempt to gain unauthorized access to any systems or networks
  • Interfere with or disrupt the Apps or servers

6. Intellectual Property

All content, features, and functionality of the Apps, including but not limited to text, graphics, logos, icons, images, audio clips, and software, are owned by vcxz and are protected by international copyright, trademark, and other intellectual property laws.

7. Disclaimer of Warranties

THE APPS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APPS WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

FOR PANDALARM SPECIFICALLY: WE DO NOT GUARANTEE THE ALARM WILL WAKE YOU UP. YOU ARE SOLELY RESPONSIBLE FOR WAKING UP ON TIME FOR IMPORTANT EVENTS.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VCXZ SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE APPS.

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID FOR THE APPS IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

9. Indemnification

You agree to indemnify and hold harmless vcxz and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of your use of the Apps or violation of these Terms.

10. Termination

We may terminate or suspend your access to the Apps immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the Apps will immediately cease.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes through the Apps or by other means. Your continued use of the Apps after changes constitutes acceptance of the new Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
